Bioengineering disclosure requirement

Yesterday I submitted some items from the Kroger scorecard.  They were all kicked back with the message that the bioengineering field was required to be completed.  I checked with our quality people, and they have some questions since this was just passed and compliance is not required until 2022.  Is this asking if the ingredient from the list is present in any amount or is it just a disclosure statement?  What level of refinement or percentage is required?

Good morning.  We worked with Kroger into the evening on this error message you and a few other customers received for the “National Bioengineered Food Disclosure” attribute.   Kroger removed this error message the evening of 8.11.20 for now.  There will be more information about this attribute and any requirements around it. 

The attribute "Requires National Bioengineered Food Disclosure" is not required for all Kroger suppliers except for Kroger's Private Label team. If you are not sure if your product should be private label for Kroger and received this error message, we recommend you contact Kroger for additional assistance.

Kroger Error Message:

CIC999:Item Returned for Review:VENDOR TO RESUBMIT|Requires National Bioengineered Food Disclosure must be populated for this item.
