 What is “My Health My Data?
The "My Health My Data" Act refers to a policy that adheres to the Washington State "My Health My Data Act" (MHMDA), which grants individuals significant control over their health data by requiring companies to obtain explicit consent before collecting, sharing, or selling any information related to a person's physical or mental health, including data gathered from wearables, certain retail purchases, and non-HIPAA telehealth services; essentially giving consumers the right to access, delete, and restrict the collection and use of their health data.

"MHMD act aims to provide consumers with greater control over their health data and to hold businesses accountable for its collection, use, and sharing of data for any entity doing business in or targeting consumers in Washington State, including global online retailers."

    Unlike HIPAA, which primarily covers medical records, the MHMDA protects a broader range of health data that may be collected by various entities, including fitness trackers, wellness apps, and even certain retail purchases that could indicate health information.

    Any company conducting business in Washington State, or targeting products or services to Washington residents, must comply with the MHMDA inclusive of global retailer sites that can be seen and facilitate purchases by Washington State residents.
